Under the Terms, we will be collecting certain data provided by you in the course of your use of the Services (including, without limitation, personally identifiable information and data obtained in the course of application of facial recognition technologies, and such data, the “User Data”), and our mutual rights and obligations in relation to the User Data are set out below in detail. We review this Privacy Policy from time to time to make sure it complies with applicable laws and conforms to changes in our business. We may need to update this Privacy Policy, and we reserve the right to do so at any time. If we do revise this Privacy Policy, we will update the “Effective Date” at the top of this page, and the App will show you a pop up to intimate you of the change in the Privacy Policy. Your continued use of our Services constitutes your acceptance of the terms of the Privacy Policy as amended or revised by us from time to time.
We are especially sensitive about children’s information. We do not knowingly collect personal information from children under the age of 13, in accordance with the Children’s Online Privacy Protection Act and other applicable laws. If you are a parent or legal guardian of a minor child, you may use our Services on behalf of such minor child. If you have questions concerning our information practices with respect to children, or if you believe a child under the age of 13 has provided us with personal information, please email us at support@kingchildren.com.

2. User Data
We collect the following User Data during the course of provision of the Services to you, and retain such User Data in the manner set out below. By using the Services, you hereby give your consent to our collection, usage, storage, and disclosure of the User Data in the manner set out below and further described in these Terms.
In addition to the above, we may share User Data with other entities that are group entities of First Technologies, Inc. We may share User Data with service providers who perform services on our behalf. We may share User Data with business partners that provide services and functionality, and with third parties for legal reasons. We may share User Data if we reasonably believe that disclosing the User Data is needed to (i) comply with any valid legal process, governmental request, or applicable law, rule, or regulation, (ii) investigate, remedy, or enforce potential violations of the Terms, (iii) protect our rights, property, and safety, as well as those of our users, or others, or (iv) detect and resolve any fraud or security concerns.
On the basis of the above description of the manner in which we collect, store, and use the User Data, and your consent in relation to the same, you hereby provide your consent for us to transmit and use the same. Please note that we may use the User Data set out above for other purposes as well, and you hereby consent to such usage, subject to our prior notificati on of the same to you.
2.1 User Data shall not be used for marketing, advertising or use-based data mining, including by third parties. We may, however, share User Data with third parties other than advertisers or marketers in an aggregated, non-personally identifiable, or de-identified format, and you hereby provide your consent to the same.
2.2 We confirm that any third party with whom the App shares User Data, as well as any parent, subsidiary or other related entities that will have access to user data will provide the same or equal protection of user data as stated in the App’s privacy policy. User Data collected by the App, or by us in the course of use of the Services, will broadly also be used for fraud control, order verification or internal marketing purposes, or in relation to third party services to help manage communication.
2.3 You also hereby consent, by your use of the Services, to the App accessing the following features of your device: (i) camera, and (ii) gallery. In the event that you do not allow access to your device’s camera, the App will not be able to function, but the App will function in the event you do not allow it t access your device’s gallery.
3. User Data Access & Change
In the event that you wish to delete or erase the User Date collected by the App during the course of providing the Services to you, you can go the ‘Account’ settings in the App and either delete your Account, or edit the User Data stored therein. Please note that in the event you delete the picture of your face or the scan generated from the same, you will need to take another picture of your face and upload another scan of the same onto the App in order for the App to function.
4. Other Usage of User Information
4.1The App functions by (i) taking a picture of your face, (ii) using the functionality of your device’s TrueDepth sensor to construct a map of relevant points of your head, and (iii) using the points to generate a set of glasses measurements to upload to our cloud based servers to drive custom fitting of the glasses. Specifically, the picture of your face and the glasses measurements generated therefrom are private and confidential to you, and may be considered ‘User Content’/’User Data’ as defined elsewhere in these Terms – this User Data is transmitted and stored by us, and may also be stored locally on your device. We will not share this User Data (other than on an anonymized basis) with any third party unless expressly permitted by you (for example, we may share with certain other Users that Users with similar facial features typically chose a particular kind of fitting or style of glasses). We will only use this User Data to respond to technical support inquiries or to improve the fitting algorithm. If at any time, you would like this User Data to be removed from our servers, please email us at support@kingchildren.com and we will accommodate the request. If we delete this User Data at your request, we will be unable to complete an order without you subsequently uploading another picture of your face and the corresponding glasses measurements.
4.2 Any information or images shared by email with our customer service inboxes, shared through the chat feature of our app, or sent to us via in any other form will not be shared externally without explicit permission. It may be shared internally within First Technologies as necessary to train our employees or to help users fulfill their requests.
4.3 Our website uses cookies in order to ensure a consistent experience for all users. Using a browser feature that blocks cookies will not restrict access to our website, though it may lead to less optimal performance.
4.4 If you are a California resident, you have the ability to ask us for a notice identifying the categories of personal information, as defined by California Civil Code Section 1798.83, we share with our affiliates and/or third parties for their direct marketing purposes and the contact information for such affiliates and/or third parties (under California Civil Code Sections 1798.83-1798.84).
